We are Mr. Squeak Inc. ("Mr. Squeak"), and we are excited you've decided to use our services, which include our technologies, website features, applications, customer support, cleaning staff, and third-party vendors, all referred to as the "Services."

These Terms of Service ("Terms") outline the ground rules for our relationship with you. While we've tried to keep things straightforward, certain parts might still sound like legal jargon because these Terms create a legally binding contract between you and Mr. Squeak. Please read them carefully.

Definitions

  • Client: The individual or entity using our Services.
  • Initial Clean: The first cleaning service provided for a specific appointment.
  • Standard Condition: A space free from excessive clutter, recent construction, infestations, or biohazards; does not include excessive dirt like grease or mildew unless specified.
  • Biohazard: Includes, but is not limited to, human bodily fluids, animal waste, rodent feces, live/dead insects, and sharp bio-products.

1. Authority

By using our Services, you affirm that:

  • You are at least 18 years of age or the legal age of majority in your jurisdiction;
  • You have the legal capacity to enter into a contract with Mr. Squeak;
  • You will adhere to these Terms and all applicable legal standards, including local, state, national, and international laws;
  • You acknowledge that Mr. Squeak is safeguarded by trademark and copyright laws. If you're acting on behalf of an organization, you assert that you are authorized to accept these Terms and grant all required licenses.

2. Privacy and Security

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your personal information. Mr. Squeak complies with GDPR and CCPA where applicable. If you believe we're not adhering to it, contact us at contact@mrsqueak.com or call 844-833-5353.

3. Services

A. Home Cleaning Services

  • Squeak and Quick™: Features a 30-point cleaning checklist. We do not provide:
    • Vacuum
    • Mop and bucket
    • Step stool
    • Toilet brush
    • Specialty products, including but not limited to:
      • Heavy-duty bathroom cleaner
      • Wood cleaner
      • Bleach
      • Stainless steel cleaner
    If clients supply these, we will clean them after use and arrange them as directed. We'll notify clients if supplies are low or missing for future subscription services.
  • Standard Cleaning: Includes a 60-point cleaning checklist. The same equipment policy as Squeak and Quick™ applies.
  • Deep Cleaning: Comes with a 70-point checklist. We provide:
    • Vacuum
    • Mop and bucket
    • Step stool
    • Toilet brush
    • Specialty cleaning products as needed
  • Move In/Out Cleaning: Offers an 80-point checklist. We supply all necessary equipment to ensure a thorough clean.

Service Limitations:

  • We do not clean chimneys, pools, or exterior windows above ground level.
  • Services may not be available in certain regions due to logistical constraints or under extreme weather conditions.

B. Additional Home Services

  • Post-Event Cleanup: Specialized service for cleaning up after home-style parties. We offer different levels of service depending on the event's size or type. Commercial event cleanups are handled by our sister company, Mr. Squeak Commercial Cleaning Inc; see details for more information.
  • Eco-Friendly Cleaning Options: All our cleaning services utilize environmentally friendly products unless otherwise directed by the client.
  • Personalized Cleaning Plans: Customize your cleaning schedule or checklist to fit your specific needs. Contact us at contact@mrsqueak.com or call 844-833-5353 for personalized service arrangements.

C. Airbnb Cleaning Services

We do not provide additional cleaning supplies or equipment for Airbnb cleanings. Clients are expected to supply any specialty cleaning products they wish to be used. Consumables like paper towels or soaps must be restocked by the client unless otherwise arranged for an additional fee.

D. Commercial Cleaning Services

Provided by Mr. Squeak Commercial Cleaning Inc, we equip ourselves with all supplies and equipment necessary for commercial cleaning including post-event cleanups for commercial spaces. For detailed information, please visit https://www.mrsqueak.com/commercial.html.

Maintenance Cleaning for New Constructions: While not currently offered by Mr. Squeak Inc., this service can be provided by Mr. Squeak Commercial Cleaning; contact them for more information.

General Note:

For all services where we do not provide specific equipment or supplies, we will gladly use client-provided items if they are clearly available with usage instructions. We require access to running water for all our services. Our cleaning staff are all pet-friendly, professionally trained, bonded, and insured. We do not clean antiques, high-value art, or electronics unless specifically directed with liability waivers in place.

4. Squeak Guarantee

"If it's not up to squeak, we'll clean it again for free." Here's the deal:

  • If you're not happy with the Initial Clean, you can request a complimentary re-clean ("Complimentary Re-clean") within 48 hours of the Initial Clean by emailing us at contact@mrsqueak.com or calling 844-833-5353. The Complimentary Re-clean must be scheduled and completed within 72 hours of your request.
  • Proof of dissatisfaction (e.g., photos or detailed feedback) is required to request a re-clean.
  • The following are not covered by our Squeak Guarantee:
    • Items not on our cleaning checklist;
    • Free clean promotions;
    • Subsequent Complimentary Re-cleans;
    • Properties not in standard condition (e.g., biohazards, hoarding);
    • Post-construction or post-renovation cleans;
    • Move-out cleans.
  • There's no cap on Complimentary Re-cleans, but we reserve the right to adjust future cleanings or void our Squeak Guarantee if requests are excessive.
  • Any additional services added to a Complimentary Re-clean will incur charges.

5. Safety

We aim for safety for all involved. Our cleaners are vetted, insured, bonded, and trained. We can remove our team from a site if it becomes unsafe.

Client Responsibilities:

  • Notify us about fragile items before the clean.
  • Secure valuables.
  • Inform us about pets and ensure they're safely contained.
  • Remove any biohazards; if present, clients must inform us of the nature and location of such hazards.
  • Adhere to our Safety Protocols.
  • Do not require or request the lifting or moving of furniture or heavy items.
  • Ensure any construction is completed before our arrival.
  • Inform us about security systems or cameras in advance.

Standard Condition: A space free from excessive clutter, recent construction, infestations, or biohazards. Areas with excessive dirt, grease, mildew, or mold may require additional fees or specialized cleaning, which must be discussed beforehand.

6. Cancellation Policy

  • A $50 fee applies for cancellations made after 3PM EST the day before an appointment, except for specialty cleans where a 50% fee of the quoted price applies if not canceled by the same deadline.
  • For recurring services, you must cancel by 3PM EST the day before to avoid fees, but you can cancel future appointments without additional cost.
  • Repeated last-minute cancellations might lead to account suspension or additional fees.
  • Rescheduling due to emergencies or extenuating circumstances can be handled with flexibility; contact us for details.

7. Damages

We strive for professionalism, but in case of damage:

  • Notify us within 48 hours via email or phone with photos and damage estimates.
  • Do not repair or replace items without our approval except in emergencies.
  • We may contract professionals for repairs, managing payments directly.
  • Our liability for damages will not exceed the cost of the service provided.

Liability Waiver:

Clients may be required to sign a liability waiver for cleaning high-value items or in environments with hazardous conditions.

8. Pricing and Discounts

Payment Terms:

  • We accept credit cards and online payments, cash is not accepted for services.
  • A deposit may be required for large bookings or special events.
  • Late payments may incur a fee and could result in service suspension.

We may adjust our pricing or discount policies at any time. These changes take effect immediately unless otherwise noted.

  • Services booked before a price change will maintain their original price unless modified. Email notification will be given if existing services are affected by price changes. Pricing is always current on your dashboard.
  • Discounts or promotional offers have expiration dates and are subject to terms; they cannot be combined unless specified otherwise.

9. Electronic Services and Licenses

Mr. Squeak provides you a personal, non-transferable license to use our electronic services like the mobile app, user dashboards, and websites. Do not copy, modify, or reverse-engineer our software without permission.

10. Your Account

You agree to:

  • Use only one account;
  • Not create a new account if your current one is disabled without permission;
  • Keep your password private.

Account Recovery: If you forget your password or suspect unauthorized access, contact us immediately at contact@mrsqueak.com for assistance.

Credits and discounts are non-transferable and not cash-redeemable. Violations lead to account deactivation and loss of credits. Report any unauthorized access to us.

11. Third-Party Entities

We're not responsible for third-party content linked to our Services. Their terms govern their services, not ours. Mr. Squeak does not endorse third-party products or services and assumes no liability for damages caused by their use.

12. Modifying the Services and Termination

  • We can change or end our Services at any time. You will be notified via email or through our Services of significant changes or pricing adjustments.
  • You can stop using our Services by deleting your account, or we might end your access for various reasons like unpaid balances.

13. Indemnity

You agree to protect Mr. Squeak and its affiliates from claims arising from your use or misuse of our Services or breaches of these Terms.

14. Disclaimers

Our Services are provided "as is" without guarantees. We aim for a good experience but can't ensure perfection in all aspects.

15. Limitation of Liability

To the extent permitted by law, we're not liable for indirect, special, or consequential damages resulting from your use or inability to use our Services, including but not limited to missed appointments or inconvenience caused by delays.

16. Dispute Resolution

A. Small Claims Court

We can each bring claims to small claims court.

B. Arbitration

Disputes not suitable for small claims will go to binding arbitration in accordance with New York law, except for intellectual property disputes seeking equitable relief.

  • Arbitration Rules: Governed by the AAA under the Federal Arbitration Act.
  • Non-appearance Arbitration: For claims under $25,000, can be done remotely.
  • Arbitration Fees: We cover fees beyond a reasonable estimate if you can't afford them; otherwise, each party pays their own legal fees unless otherwise awarded by the arbitrator.
  • Arbitrator's Authority: Broad but individual, no class actions.
  • Opt Out: You have 60 days to opt out of arbitration.
  • Waiver of Jury Trial: Both parties waive jury trials for arbitration disputes.
  • Waiver of Class Actions: Claims must be individual, not class-based.

C. Exclusive Venue

For court cases, New York State has jurisdiction.

17. Choice of Law

New York law applies to these Terms.

18. Severability

If any part hereof is invalid, the rest remains enforceable.

19. Additional Terms for Specific Services

We might have additional terms for specific services. If they conflict with these Terms, the specific terms apply.

20. Refund Policy

We generally do not provide refunds but strive to resolve issues through our Squeak Guarantee. If you believe a refund is warranted, contact us within 48 hours of the Initial Clean with an explanation.

Separate written agreements with different refund policies take precedence.

21. Solicitation of Our Cleaners and Employment Practices

Hiring or soliciting our cleaners within 24 months from their employment with us or engaging in side deals up to 18 months after your last service with us incurs a $25,000 fee. You must report any such attempts. Violating this leads to added legal fees. Exchanging contact details is considered a breach.

22. Client Responsibilities

  • Provide timely access to the property for cleaning.
  • Clearly indicate fragile items or areas requiring special attention.
  • Ensure the property is in a condition suitable for cleaning as per our standards.

23. Force Majeure

Mr. Squeak shall not be liable for any delay or failure in performance due to events beyond our control, including, but not limited to, natural disasters, power outages, acts of government, or labor disputes.

24. Recurring Services Policy

Recurring clients may enjoy loyalty discounts and priority scheduling.

Cancellation terms for recurring services remain as outlined in the Cancellation Policy, but we offer flexibility for long-term clients facing unforeseen circumstances.

25. Training Standards

Our staff undergoes rigorous training, including certifications in cleaning techniques, safety protocols, and customer service. We are committed to ongoing education to maintain service excellence.

26. Client Feedback and Reviews

We encourage feedback after each service through our platform or directly via email. With your consent, we may publish testimonials on our website or marketing materials.

27. Environmental Commitment

We are dedicated to sustainability, using eco-friendly cleaning products and implementing practices that reduce our environmental impact. Our commitment includes reducing waste and using energy-efficient equipment where possible.

28. COVID-19 or Health Protocols

In response to health concerns like pandemics, we implement additional safety measures including the use of PPE, sanitizing protocols, and contactless service options. We adhere to public health guidelines and may adjust our practices as necessary.

29. Updates to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page, and by email where possible, before the changes take effect. Continued use of our Services post-update signifies your acceptance of the new Terms.

30. Final Terms; No Third Party Beneficiary, No Waiver; No Assignment; Reservation of Rights

These Terms, along with any additional terms, are our full agreement. No third-party benefits, no implied waivers, no rights assignment without consent. All rights not granted here are reserved.
